ARTICLE  I - Name and Objects

Section 1:  The name of this Association shall be:

KANSAS ASSOCIATION OF F.S.A. COUNTY EMPLOYEES

Section 2:  The Objectives of this Association shall be:

(a)  To maintain and improve the confidence in and respect of the Public for the FSA county employees and for the Farm Service Agency Committee.
(b)  To promote the welfare of the Kansas people engaged in farming operations and the Kansas agriculture.
(c)  To co-operate with the Kansas FSA Committee and the State Administrative officer and his staff to improve the Farm Service Agency programs in Kansas.
(d)  To assist in organizing similar associations in other states so that a National organization of FSA County Employees can be effected.
(e)  To promote and put into effect a program placing the FSA County employees on an equal basis with other federal employees, taking into consideration the rights, privileges and protection of other federal employees.
(f)  To promote and put into effect a program to improve the professional status and qualifications of its membership.

ARTICLE  II - Membership

Section 1:

(a)  Any regular leave earning Kansas county employees may become a "regular member" of this association upon payment of the annual membership dues as hereinafter provided.
(b)  All other persons not defined in Section (a), Article II above associated with the administration of FSA programs may become an "Associate Member" of this association upon payment of the annual membership dues as hereinafter provided.
(c)  Any person retired or terminated without prejudice from Kansas FSA employment is eligible to become an associate member.

Section 2:

A quorum for transaction of business at any meeting of the membership of this association shall constitute a majority of the regular members present.

Section 3:

Robert Rules of Order shall cover the discussions and parliamentary procedure in all meetings of this Association.

ARTICLE  III - Dues

Section 1:
The dues of the members shall be payable annually in advance on or before July 1 of each year and shall become delinquent after July 1 of each year.

Section 2:

The dues of the membership shall be as outlined on the attached Exhibit 1 of these By-laws.

Section 3:

Ten percent of all dues collected shall be retained at the district level to be used as needed.  Additional dues collected in excess of those specified in Section 2 shall be retained in the district.

ARTICLE  IV - Officers

Section 1:

The officers of this association shall be president, a first vice-president, a second vice-president, and a secretary-treasurer.
Section 2:
At each annual Board of Directors meeting, the directors shall elect the officers of this association and one representative to the National Association Conference from the members of the Board of Directors.
Section 3: Duties
The president shall preside at all directors' and members' meetings, shall have general supervision over the other officers, be the general manager of the Association, delegate to the National Association Conference and perform all such other duties as are incident to his office.  In case of the absence or disability of the president, his duties shall be performed by the first vice-president.  The first vice-president shall perform such duties as the president shall determine.  The second vice-president shall perform such duties as the president shall determine.  The secretary-treasurer shall issue notices of all directors' and members' meetings and shall attend and keep the minutes of the same, have charge of all books, records, and papers of the association, and shall perform all such other duties as are incident to his office, to include the handling of the associations' funds as hereinafter described and shall further submit an audited financial report of the association annually to the Board of Directors.
Section 4:
The secretary-treasurer shall be adequately bonded as deemed necessary by the Board of Directors.
Section 5:  Vacancies
In case of the absence or disability of the president, his duties shall be performed by the first vice-president.  In the event of the absence or disability of the first vice-president, his duties shall be performed by the second vice-president.

ARTICLE  V - Board of Directors
Section 1:
The Board of Directors shall be composed of a director or his alternate from each of the KASCOE districts in the State of Kansas.  This districts shall be nine in number and shall be composed of the following counties:
  District No.1: Cheyenne, Decatur, Gove, Lane, Logan, Ness, Rawlins, Sheridan, Sherman, Thomas, Trego Wallace.
 

District No. 2:

Barton, Ellis, Ellsworth, Graham, Norton, Osborne, Phillips, Rooks, Rush, Russell, Smith.
  District No. 3: Clay, Cloud, Dickinson, Jewell, Lincoln, Mitchell, Morris, Ottawa, Republic, Saline, Washington.
  District No. 4: Atchison, Brown, Doniphan, Geary, Jackson, Jefferson, Leavenworth-Wyandotte, Marshall, Nemaha, Pottawatomie, Riley.
  District No. 5: Anderson, Chase, Coffey, Douglas Franklin, Johnson, Linn, Lyon, Miami, Osage, Shawnee, Wabaunsee.
  District No. 6: Allen, Bourbon, Chautauqua, Cherokee, Crawford, Elk, Greenwood, Labette, Montgomery, Neosho, Wilson, Woodson.
  District No. 7: Butler, Cowley, Harper, Harvey, Kingman, Marion, McPherson, Reno, Rice, Sedgwick, Sumner.
  District No. 8: Barber, Clark, Comanche, Edwards, Ford, Gray, Hodgeman, Kiowa, Meade, Pawnee, Pratt, Stafford.
  District No. 9: Finney, Grant, Greeley, Hamilton, Haskell, Kearney, Morton, Scott, Seward, Stanton, Stevens, Wichita.
Section 2:  Election
Each KASCOE district in the State of Kansas shall elect a director and alternate director by vote of the members of each district.  Such election shall take place not later than October 1 of each election year.  Each such director shall be elected for a term of two years or until such time as his successor is elected and qualified: except for the first year, effective January 1, 1960, odd numbered districts will elect for a term of one year and even numbered districts shall elect for a term of two years, the term of office to begin January 1 of each year.
Section 3:  Meetings
The Board of Directors shall meet in January of each year.  Special meetings of the Board of Directors may be called by the President or by any five members of the board at such place within the State of Kansas as specified in the "Call" therefore.
Section 4:
A quorum for the transaction of business at any regular or special meeting of the directors shall consist of five members of the board; but, in the absence of a quorum, a majority of those present at any regular or special meeting shall have the power to adjourn the meeting to a future date.
Section 5:  Committees
The number of committees, their nature and duties shall be such as the Board of Directors shall determine.  All committees shall be appointed by the president of the Association.
Section 6:  Vacancies
In case of transfer of director out of a district, they will no longer serve as a director, nor as a delegate.  A new delegate must be selected out of the remaining directors.  The alternate director will fill the unexpired term.  In case of disability, resignation or transfer of both the director and alternate, the district membership shall immediately elect a successor to fill the unexpired term.  In case of absence, disability, resignation or removal for cause of any of the officers of this Association such vacant office shall be filled by the appointment of the president until such time as the Board of Directors shall next meet and elect a successor.  In the event an officer of this Association, loses his directorship solely due to transfer from the district from which elected, he shall complete his term as an officer without voting rights.
Section 7:  Duties
The property, affairs and business of the Association shall be managed by the Board of Directors, which may exercise all the powers of the Association, except so far as by law and by the constitution and by-laws expressly conferred upon or reserved to the members.  The Board of Directors shall have the power to fix the compensation of its members and provide for the payment of their expenses in attending the meetings of the board.  The president of this Association shall also serve as chairman of the Board of Directors.
Section 8:
The outgoing President shall also be a member of the Board of Directors as an "Advisor" with no voting rights, for a period of one year after the presidency is vacated, provided his eligibility as a regular member of the association is retained.

ARTICLE  VI - Financial Matters

Section 1:
The secretary-treasurer shall have custody of all monies of the Association and shall deposit all funds of this association in a bank or banks insured by the Federal Deposit Insurance Corporation, in the name of the Association, shall keep regular books of account and submit them together with all of his vouchers, receipts, records, and other papers, to include records of collections and withdrawals, to the directors, for their examination and approval as often as they may require.
Section 2:
The President and Secretary-Treasurer shall approve the withdrawal of any and all funds from the account of the Association.
Section 3:
The President and Secretary-Treasurer shall not approve the payment of any expenses incurred by any person or committee until proper and necessary account of the expense is presented to and filed with the Secretary-Treasurer.
Section 4:
The Board of Directors shall provide for payment upon adequate commercial bonding of the Secretary-Treasurer.

ARTICLE  VII - Amendments

Section 1:
Any and all provisions of this constitution and by-laws may be amended, revised, or repealed and additional or supplementary by-laws may be adopted:
(a) By the Board of Directors on affirmative vote of two-thirds of the Board members; and such voting shall be made a matter of record.
(b) At any regular meeting of the members, without notice, or at any special meeting of the members called for that purpose.
(c) In the form of amendments or revisions and shall go into effect immediately unless otherwise designated.

Certification of Adoption
The above and foregoing Constitution and By-laws were duly and regularly adopted as the Constitution and By-laws of the Kansas Association of FSA County Employees at the annual meeting of the Board of Directors, had and held on the 15th day of January, 1996, and have been duly amended by authority and reference as indicated.
 

Amendments as of 1-15-96:

All references to ASCS or ASC has been changed to reflect FSA
    Article V, Section, District 1 changed to 9, District 2 changed to 8, District 3 changed to 6, District 4 changed to 5, District 5 changed to 7, District 6 changed to 4, District 7 changed to 3, District 8 changed to 2 and District 9 changed to 1.
    New District No. 4 replaced Washington County with Geary County and New District No. 3 replace Geary County with Washington County
    Exhibit 1- "Dues" amended to show change in determining dues to be collected based on factor .0020.

The above and foregoing Constitution and By-laws were duly and regularly adopted as the Constitution and By-laws of the Kansas Association of FSA County Employees at the Annual State Convention, had and held on the 7th day of October, 1999, and have been duly amended by authority and reference as indicated.

  Amendments as of 10-7-99: Article V, Section 1, Woodson County added to District No. 6.

 

KASCOE TRAVEL POLICIES

A.   Guest of the Executive Committee -If bringing guests, anyone on the KASCOE  Master  Account will be liable to pay for one-half the room cost, plus any additional related expenses.

B.   Mileage Rate - Mileage rate for automobile travel will be the same as paid by FSA for employees on official travel.  With regards to travel, our past policy has been to combine travel whenever possible so that expenses area kept to a minimum.

C.   Meals and Incidental Expenses - KASCOE will pay actual expenses for M&IE not to exceed the CONUS rate for the location.  Any claim submitted that exceeds the CONUS rate, will require receipts and written justification.  M&IE payment for first and last day of travel will be limited to actual expenses and shall not to exceed ¾ of the CONUS rate for the location.

D.   Authorized Travel Dates - Any travel outside of the authorized “travel-in” and “travel-out” dates, must be requested in writing, be necessary, benefit KASCOE, and be pre-approved by the Executive Committee. 

E.   Emergency Situations If it is necessary and if it benefits KASCOE, the President may approve any unauthorized travel expenses not noted above, and will be subject to review by the Executive Committee.

F.   Claims for Reimbursement All claims for reimbursement must be submitted to the KASCOE Treasurer within 6 months of incurred expense unless there are extenuating circumstances that would require Executive Board approval.
